1. Partner Program and Definitions

1.1. Affiliate/Partner: An individual or legal entity, 18 years of age or older, promoting the KMB Media Group Affiliate Program’s product on the Internet.

1.2. Affiliate Program: A technical marketing platform providing advertising materials to webmasters to promote products of the KMB Media Group Affiliate Program on the Internet.

1.3. Product: A project (betting, casino) advertised with the help of promotional materials on the Internet.

1.4. Promotional Materials (Promo): Tools used by Partners to promote the product of the Affiliate Program on the Internet.

1.5. Traffic: The totality of players who come as a result of Partner’s advertising materials on the Internet.

1.6. Offers: Terms and conditions placed by the Partner(s) to promote the product of the Affiliate Program on the Internet.

1.7. Commissions: Payment for a specific result of placing advertising materials by the Partner on the Internet.

1.8. CPA (Cost Per Action): The result means making the first deposit, brought by the player.

1.9. Revenue Share: Percentage from Net Gaming Revenue.

1.10. Hybrid: Consists of two paid results. The 1st event is the making of the first deposit by the player, and the 2nd event is a percentage from Net Gaming Revenue.

1.11. Players: Persons who came to the product’s website through the promotional material used by the Partner and who registered a personal account.

1.12. Hold: The time during which the player has to get the status of a “Qualified Player.” During this time, the player is checked for rule violations.

1.13. Qualified Player: A player who regularly returns to the Product, makes deposits (bets), and plays for real money.

1.14. Reporting Period: The time interval during which the money earned by the Partner is accumulated and calculated for withdrawal.

2. Rules for Working with the Partner Program

Affiliates play a vital role in the success of KMB Media Group’s Affiliate Program. To ensure a fair and mutually beneficial partnership, it is crucial to understand and adhere to the following rules and regulations:

2.1. Agreement Acceptance

  • Upon entering the KMB Media Group Program, every prospective affiliate is required to thoroughly read and accept the Terms of Use Agreement. This step is essential to establish a clear understanding of the expectations and obligations associated with our partnership.

2.2. Agreement Amendments

  • We value transparency and may update the Terms and Conditions without prior notice. As such, affiliates should periodically review these terms to stay informed about any changes that may affect our collaboration.

2.3. Age Requirement

  • To participate in the Partner Program, affiliates must be 18 years of age or older. Age verification is a fundamental prerequisite to ensure compliance with legal regulations.

2.4. Right to Refusal

  • KMB Media Group reserves the right to refuse cooperation with any affiliate without the obligation to provide detailed reasons for this decision. While we aim to foster collaborative relationships, certain circumstances may necessitate a refusal.

2.5. Agreement Updates

  • The Affiliate Program may make changes to the Affiliate Program User Agreement. It is important to understand that all documents published on the program’s website are considered valid at the time of your interaction. We do not maintain a record of changes to the Affiliate Program rules over time.

2.6. Quality Requirement Compliance

  • The Affiliate Program reserves the right not to pay earnings to affiliates based on the CPA model if the players referred by the affiliate do not meet the minimum quality requirements. This includes situations such as multi-accounts (where several accounts belong to one player) or if more than 5% of users request a refund (charge-back).

2.7. Prohibited Self-Registration

  • Affiliates and individuals personally acquainted with affiliates are strictly prohibited from registering accounts in the Products through their advertising materials. Any instances discovered will result in the immediate blocking of the player’s account and a full write-off.

2.8. Cookie-Stuffing Restrictions

  • The Affiliate Program strictly prohibits the use of cookie-stuffing, including cookie-stuffing on the SuperBoss brand. This practice undermines transparency and fairness in our partnership.

2.9. Link Verification

  • Affiliates must independently verify the performance of their provided links and the accuracy of any additional parameters. Non-functional links may result in untracked players.

2.10. Link Validity Period

  • Postclick links remain active for 30 days. Beyond this period, any associated parameters will be erased. Affiliates should monitor the validity of their links to ensure proper tracking.

2.11. Source of Traffic Disclosure

  • The Affiliate Program reserves the right to request information regarding the traffic sources used by affiliates for promoting the Product. Failure to provide this information may lead to the termination of the cooperation.

2.12. Payment Blockage and Violation Investigation

  • In cases where the Partner Program suspects a violation of its rules, it may temporarily block payments to the affiliate. The investigation period will continue until the circumstances are clarified. Following the investigation, the Partner Program reserves the right to block payments if violations are confirmed.

2.13. No Tolerance for Offensive Language

  • We uphold a strict policy against the systematic use of obscene language or insults directed at our support staff. Such behavior may result in a permanent refusal of further online support or a termination of the partnership with payment blockage.

2.14. Confidential Correspondence

  • Correspondence and personal communication with the administration, affiliate manager, or support service of the affiliate program is considered confidential information. Affiliates are prohibited from disclosing classified information or allowing third parties to access it. Violations of this rule may result in cooperation termination with payment blockage.

2.15. Advertising Material Content

  • The use of images/photos of politicians, political topics, or attributes and representatives of various religious denominations in advertising materials is strictly prohibited. The discovery of such advertising materials may result in a refusal of further online support or a termination of the partnership with payment blockage.

2.16. Termination of Cooperation

  • In cases where affiliates violate existing rules and terms of cooperation, the Partner Program reserves the right to terminate cooperation without further payment or explanation of reasons.

3. Procedure and Terms of Settlements with Partners

Ensuring transparency and reliability in our partnership, we have outlined the following procedures and terms that govern settlements with our valued partners:

3.1. Payment Currency

  • All payments made within the KMB Media Group Affiliate Program are conducted in one single currency: US dollars. This standardization simplifies payment processes and ensures consistency.

3.2. Reporting Period

  • A reporting period, established by KMB Media Group, spans a duration of 30 days. This is the time frame during which your earnings are tracked and aggregated. After the reporting period concludes, payments are verified and processed within 5 business days.

3.3. Notification of Payment Details

  • To facilitate the efficient transfer of your earnings, it is imperative to notify your affiliate account manager of any changes to your payment details at least five business days before the end of the current reporting period. This timely update ensures that payments are routed accurately.

3.4. Correct Payment Details

  • Accurate payment details are essential to ensure the successful receipt of your earnings. Please provide these details to your affiliate account manager in the correct format to facilitate smooth payout transactions.

3.5. Payment Delay (Hold)

  • The period of payment delay, referred to as the “Hold,” is determined at the discretion of the Affiliate Program administration. This delay serves various purposes, such as assessing the player’s qualification status.

3.6. Minimum Payout Thresholds

  • Affiliates should be aware that there are minimum payout thresholds for different payment models within our program. Specifically, for the CPA (Cost Per Action) model, the minimum payout starts from 5 FD (First Deposits). Meanwhile, for the Revenue Share model, it starts from $20.

4. Dispute Resolution Procedure

  • In the event of any disputes or concerns, our Affiliate Program has established a systematic and fair procedure for resolution:

4.1. Dispute Resolution Protocol:

  • The Affiliate Program does not accept or consider disputable claims related to lost profits or compensation for moral damage. Our focus is on practical and objective matters.
  • Disputes may be submitted via email to contact@kmbmediagroup.com.

4.2. Addressing Disputes and Resolving Issues:

  • We make every effort to resolve disputes through communication and negotiation. Formal appeals and requests must be submitted in writing within three calendar days from the date a dispute arises.
  • All appeals are considered official and should be in writing, sent via email to the relevant service addresses within the Partner Program. Appeals conveyed through online communication programs such as Telegram or other messengers are not considered official.

4.3. Essential Information in a Partner’s Request:

  • To ensure a comprehensive understanding of your dispute, your written request should include:
    • Your Name
    • Email Address
    • Account Number/Affiliate ID
    • Date and Time of the Disputable Situation
    • Subject Matter of the Complaint

4.4. Right to Refuse Appeals:

  • The Partner Program may choose to refuse consideration of an appeal under the following circumstances:
    • The complaint does not adhere to the conditions defined in this section.
    • The complaint contains offensive language or insults directed at the Partner Program or its employees.
    • The appeal includes threats to the Partner Program or its employees.
    • The Partner threatens to harm the Partner Program’s reputation on social networks or other platforms.

4.5. Review Period for Disputes:

  • The Partner Program commits to reviewing a Partner’s claim within a maximum of twenty working days from the moment of receiving all necessary and sufficient data related to the dispute. This information is crucial for the resolution process.

4.6. Violation Consequences:

  • In the event of a Partner’s violation of any of the stipulated items above, the Partner Program reserves the right to refuse further cooperation with the Partner.
